Product certification
Safety and quality of products supplied and manufactured in Kazakhstan is one of the most important areas of national security of the country. One of the tools for determining and ensuring product safety and quality is its conformity assessment.
The certification services in Kazakhstan are regulated by Law No. 396-VI ZRK of the Republic of Kazakhstan “On Technical Regulation” dated December 30, 2020 and the technical regulations of the Republic of Kazakhstan.
With the entry of the Republic of Kazakhstan into the Customs Union (today Eurasian Economic Union), the sphere of certification is also regulated by the Treaty on the Eurasian Economic Union dated May 29, 2014 and technical regulations of the Eurasian Economic Union/Customs Union (EEU/CU)
Product certification body
The product certification body of LLP “T-Standard” has been providing conformity assessment services since 1999.
Over the years, we have gained unique experience in confirming the conformity of products and management systems. The company has formed a strong team of qualified specialists and experts.
LLP “T-Standard” is accredited by LLP “National accreditation center” for the right to confirm compliance of products with the technical regulations of the Eurasian Economic Union (EAEU), as well as the technical regulations of the Republic of Kazakhstan, and is included in the unified register of certification bodies of the EAEU. Also, the area of accreditation of LLP “T-Standard” includes products for which there are no technical regulations, but which are subject to voluntary certification in the Republic of Kazakhstan: – electrical products with a voltage of more than 1000 V.
Confirmation of compliance is carried out using one of the following forms:
Certification is a procedure for confirming safety and quality of products, through which an accredited certification body certifies that products meet the requirements of technical regulations and/or standards in force on the territory of the Republic of Kazakhstan.
Declaration of conformity is a procedure for confirming the safety and quality of products, through which the product manufacturer or supplier certifies that the product meets the requirements of technical regulations and/or standards in force on the territory of the Republic of Kazakhstan.
Products subject to mandatory certification/declaration, if it is subject to the technical regulations of the RK or the EEU/CU TR, and also if the products are covered by the Decision of the Customs Union Commission № 620 dated April 7, 2011 “Unified list of products subject to mandatory assessment (confirmation) of conformity within the Customs Union with issue of unified documents.”
Certificates of conformity and declarations of conformity, as documents certifying the safety and quality of products, have equal legal force and are only different forms of confirmation of product conformity.
The form of conformity assessment (certificate or declaration) for each type of product is determined by the relevant technical regulations.
Payment for certification/declaration of products is made by the Applicant on a contractual basis.
EEU certificate can be issued to legal entities and individual entrepreneurs registered in the territory of the member states of the Eurasian Economic Union. Applicants can be manufacturers, vendors/suppliers, as well as enterprises that perform the functions of a foreign manufacturer on the basis of a relevant contract.
The EAEU certificate of conformity is a document certifying that the certified product meets the requirements of the technical regulations of the Eurasian Economic Union (EAEU)/ Customs Union (CU)
EAEU certificates of conformity are valid throughout the territory of the EAEU and do not require re-certification in the EAEU member States to obtain national certificates of conformity for the same requirements that the EAEU certificate was issued for.
The EAEU Certificate of conformity is required for the import of goods, as well as for their sale and circulation on the territory of the EAEU member States (Russia, Belarus, Kazakhstan, Armenia, Kyrgyzstan).
The certificate is issued on a standard form and is certified by the stamp of the certification body. All certificates issued by the certification body are subject to mandatory registration and are entered in the unified electronic register of issued certificates of conformity.
EAEU declaration of conformity
EAEU Declaration of conformity is a document certifying that the declared product meets the requirements of the technical regulations of the Eurasian Economic Union (EAEU)/Customs Union (CU).
Declarations of conformity of the EAEU are valid throughout the territory of the EAEU and do not require repeated confirmation of compliance in the EAEU member States in order to obtain national certificates/declarations of conformity for the same requirements that the EAEU Declaration was issued for.
EAEU Declaration of conformity is required for the import of goods, as well as for their sale and circulation on the territory of the EAEU member States (Russia, Belarus, Kazakhstan, Armenia, Kyrgyzstan).
Declaration of conformity is drawn up on white A4 paper and stamped by the applicant.
All issued declarations are subject to mandatory registration with the certification body and are entered in the unified electronic register of declarations of conformity.
Certificate of conformity of the Republic of Kazakhstan (RK) is the document certifying conformity of certified products with the technical regulations of Kazakhstan or other regulatory documents of the RK (for example, the standards applicable on the territory of Kazakhstan).
Certificates of conformity of the Republic of Kazakhstan are valid only on the territory of the Republic of Kazakhstan.
LIST OF DOCUMENTS REQUIRED FOR CERTIFICATION
- Information about the products claimed for certification (product name, purpose, type / model, HS code of the EAEU, manufacturer, country)
- Operational documents for products (passport, operating manual, catalog)
- Factory test reports, protocols, and product tests.
- Certificates of conformity for materials and components or reports on their tests (for complete equipment).
- Name and designation of regulatory documents according to which products are manufactured
- Information about product storage conditions and terms, as well as product service life
- Information about the legal and actual addresses of the manufacturer
- Certificate of conformity of the manufacturer's quality management system to ISO 9001 (if available).
- Sample product marking (for example, photo or drawing of label)
- Explanatory note / safety justification (document containing risk analysis, as well as information from design, operational, and technological documentation on the minimum necessary measures to ensure product safety at all stages of its life cycle) (for products that fall under the technical regulations of the Customs Union)
- Documents and information about the applicant (certificate of state registration, information about legal and actual addresses of the applicant, phone/fax, e-mail, bank details: current account, BIC, KBE, BIN, position and full name of the head of the company)
- Agreement between the applicant and the manufacturer on the applicant's responsibility for product compliance with the technical regulations of the Customs Union (for serial certification of products that fall under the technical regulations of the Customs Union).
- Shipping documents (invoice or contract for the supply of products, customs declaration) – when certifying a batch/individual product
PROCEDURE FOR OBTAINING EAEU CERTIFICATE OF CONFORMITY
- submission of application by the applicant to the certification body (documents according to a certain list shall be submitted together with the application);
- review of the application by the authority and preliminary analysis of submitted documents in order to determine the possibility of carrying out certification of the claimed products;
- approval of the terms of work with the applicant and conclusion of the contract;
- identification of the product and/or samples (depending on certification scheme);
- testing of product samples in an accredited testing laboratory (if this is provided for in the certification scheme);
- analysis of the state of production (if provided for in the certification scheme);
- review of test results, analysis of production status, submitted documentation, and making a decision on issuing certificates of conformity;
- registration, issuance of certificates of conformity;
- registration, issuance of certificates of conformity;
- The applicant can only be a legal entity registered in the Republic of Kazakhstan or in another EAEU member state. This legal entity must be the manufacturer of the claimed product, or a supplier, or must have a contract with the manufacturer, located outside the territory of the EAEU member States, confirming that the applicant is the authorized person of the manufacturer on the territory of the EAEC and is responsible for ensuring compliance of the products supplied to the territory of the EAEU with the requirements for the relevant TR EAEU /CU.
PROCEDURE FOR OBTAINING CERTIFICATE OF CONFORMITY OF THE REPUBLIC OF KAZAKHSTAN
- The procedure for obtaining a certificate of conformity of the Republic of Kazakhstan includes the following stages:
- review of the application by the authority and preliminary analysis of the submitted documents in order to determine the possibility of carrying out certification of the claimed products;
- approval of the terms of work with the applicant and conclusion of the contract;
- identification of the product and/or samples (depending on the certification scheme);
- testing of product samples in an accredited testing laboratory (if this is provided for in the certification scheme);
- analysis of the state of production (if provided for in the certification scheme);
- review of test results, analysis of production status, submitted documentation, and making a decision on issuing certificates of conformity;
- registration and issuance of certificates of conformity;
- carrying out annual inspection control of certified products (in case of certification of the serial production).
PROCEDURE FOR REGISTERING EAEU DECLARATION OF CONFORMITY
- submission of application by the applicant to the certification body (documents according to a certain list shall be submitted together with the application);
- review by the authority of the application and preliminary analysis of the submitted documents in order to determine the possibility of carrying out work on registration of the Declaration of the declared products;
- approval of the terms of work with the applicant and conclusion of the contract;
- product identification;
- final analysis of submitted documents and decision on registration of the Declaration of conformity;
- preparation, registration and issuance of a Declaration of conformity.
- The applicant can only be a legal entity registered in the Republic of Kazakhstan or in another EAEU member state. This legal entity must be the manufacturer of the claimed product, or a supplier, or must have a contract with the manufacturer, located outside the territory of the EAEU member States, confirming that the applicant is the authorized person of the manufacturer on the territory of the EAEC and is responsible for ensuring compliance of the products supplied to the territory of the EAEU with the requirements for the relevant TR EAEU /CU.
Rights and Obligations of the Applicant/Customer
1.1 Pay in accordance with the established procedure all expenses related to the work on conformity assessment of products, regardless of the results.
1.2 Comply with and meet the requirements established by the rules of conformity assessment, including annual inspection control and implementation of relevant changes brought to it by the certification body of LLP “T-Standard” (organ of conformity assessment).
1.3 If a conflict of interest is found, bring this fact to the attention of the organ of conformity assessment to prevent impartiality.
1.4 Provide all necessary conditions for performing conformity assessment work, including providing documents and records for review, as well as access to the relevant equipment, location, territory, personnel and subcontractors of the customer.
1.5 Provide the Contractor with samples of products for testing in the amount provided for in the regulatory documents for products (if this is stipulated by the conformity assessment scheme).
1.6 If necessary, provide an opportunity for participation of observers from the organ of conformity assessment in the product evaluation process.
1.7 In case of positive results of work on conformity assessment:
— to comply with the requirements for labeling and packaging of products stipulated in applicable technical regulations of the EEU TR/ CU TR/ RK TR;
— be responsible for the quality and safety of products that have passed the conformity assessment procedures, and ensure the stability of product characteristics;
— use the certificate of conformity only to confirm that the product meets the requirements specified in the RD or TR certificate;
— do not use the certificate of conformity in a way that creates a negative opinion about the organ of conformity assessment;
— do not make any statements regarding the conformity assessment of your products that may be considered misleading and/or unfounded;
— when referring to the certificate of conformity in the media (in documents, brochures, advertising materials), comply with the requirements of the organ of conformity assessment.
1.8 Keep records, review and take appropriate action on complaints submitted, and provide information about them at the request of the organ of conformity assessment.
1.9 Notify the organ of conformity assessment in writing within 10 days of design and technological changes to the products and the process of their production and labeling, as well as changes to their legal address, legal status and payment details.
1.10 After suspension, cancellation or termination of certificates of conformity, the applicant must stop using all advertising materials that contain any references to certification and take measures required by the certification scheme.
2.1. Request and timely receive information about the rules and procedures for conformity assessment, regulatory requirements for products established in the TR of the Republic of Kazakhstan/TR of the Customs Union.
2.2 Get information about the progress of work at any stage, make written comments in case of shortcomings in the work of the organ of conformity assessment.
2.3 Submit claims to the organ of conformity assessment in writing on the quality of work performed.
